Lot Split Application Instruction Sheet

From filing to decision, lot-split applications typically take two (2) months. A lot-split is the process of dividing a lot of record into two or more tracts, each of which is less than two and one-half (2.5) acres. The City Planner assigned to your petition will be your main contact person throughout the process. Feel free to call whenever you have questions or concerns.

Application Review

The deadline for submitting an application with the Planning Commission is the first Tuesday of each month. It is recommended that, prior to submitting an application, you schedule a pre-application meeting with the City Planner. Materials that need to be submitted at the time of application are listed below.

  1. Legal description of the undivided tracts and tracts to be created;
  2. Filing fee (see Schedule of Fees – Planning and Zoning);
  3. Completed application form;
  4. Survey, site plan or drawing that shows the existing conditions; and
  5. Survey, site plan or drawing that shows the proposed conditions.

Staff Report

Upon receipt of the completed application and additional requirements, the City Planner will begin preparing the applicant’s case for formal presentation to the Planning Commission. This will include the distribution of the application packet to the Technical Advisory Committee (TAC). The TAC is made up of representatives from the City of Owasso City Manager’s Office, Community Development Department, Fire Department, Public Works Department, Oklahoma Natural Gas (ONG), Southwestern Bell, Public Service Company of Oklahoma (PSO) and Cox Communications. The City Planner will complete a staff report which will include background information on the subject property as well as findings related to the City of Owasso Zoning Ordinance, Subdivision Regulations, site visits and any other information needed to complete the requested review. The staff report will also include a recommendation to approve or deny the request along with a general area map.

Planning Commission

The Planning Commission makes the final decision, taking into consideration staff’s recommendation and report, the testimony of the applicant and any other interested parties. The TAC meets on the fourth Wednesday of the month at 2:00pm in which the application is filed. The Planning Commission meets on the second Monday of the month at 7:00pm following the TAC meeting. For those lot-split applications requiring waivers, the Board of Adjustment will hear the case after it has been ratified by the Planning Commission (see Board of Adjustment Application Instruction Sheet). The public hearing begins with the announcement of the application. It is recommended that the applicant or his / her representative be present at the public meeting as he / she will be given time to add to staff’s presentation. Any interested parties will be given equal time to protest or support the application. Upon hearing all comments relative to the lot-split application, the Planning Commission will vote to approve, approve conditionally or deny the request. If your request is approved, you may bring your instrument of transfer (deed) to the Community Development Department for endorsement by the Chairperson of the Planning Commission. The instrument of transfer should then be filed in the Office of the County Clerk and a copy presented to the City Planner.

Appeals from Planning Commission Decisions

If an application is denied, the applicant may appeal the Planning Commission’s decision to the City Council.
