How To Apply To The Board of Adjustment
From filing to final decision, applications with the Board of Adjustment typically take one (1) month. The Board of Adjustment may hear and decide appeals from decisions made by any administrative official in the enforcement of any zoning ordinance including but not limited to variances and special exceptions. The City Planner assigned to your petition will be your main contact person throughout the process. Feel free to call whenever you have questions or concerns.
Application Review
The deadline for submitting an application with the Board of Adjustment is the first business day of each month. It is recommended that, prior to submitting an application, you schedule a pre-application meeting with the City Planner. Materials that need to be submitted at the time of application are listed below.
- Legal description of the subject property;
- Certified three-hundred (300) foot radius report (applicant to obtain from a title or abstract company);
- Filing fee (see Schedule of Fees – Planning and Zoning);
- Completed application form; and
- Survey, site plan or drawing that shows the subject property.
Public Notice
Once the application is deemed complete, the petition is scheduled for a public hearing before the Board of Adjustment. The owners of all property within three hundred (300) feet of the perimeter of the property will be notified from a certified radius report supplied by the applicant. The City Planner will also publish a legal notice in the Owasso Reporter at the applicant’s expense. The applicant will be billed directly by the Owasso Reporter.
Staff Report
The City Planner will prepare a staff report for the Board of Adjustment. The staff report will include background information on the subject property as well as findings related to the City of Owasso Zoning Ordinance. The City Planner will evaluate the petition to determine whether or not the request meets all of the criteria described on either the variance application or the special exception application form. The staff report will also include a recommendation to approve or deny the request along with a general area map.
Board of Adjustment
The Board of Adjustment makes the final decision, taking into consideration staff’s recommendation and report, the testimony of the applicant and any other interested parties. The Board of Adjustment meets on the fourth Tuesday of the month at 6:00pm in which the application is filed. The public hearing begins with the announcement of the application. It is recommended that the applicant or his / her representative be present at the hearing as he / she will be given time to present testimony. Any interested parties will be given equal time to protest or support the application. Upon hearing all of the evidence and testimony relative to the variance or special exception application, the Board of Adjustment will vote to approve, approve conditionally or deny the request. If your request if approved, you may seek a building permit, (if applicable), to use the property or structure in accordance with the Board of Adjustment’s approval.
Appeals from Board of Adjustment decisions
If a petition is denied, the applicant may appeal the Board of Adjustment’s decision to the District Court.
