Owasso Business GraphicHow To Apply For Rezoning

From filing to final decision, rezoning applications typically take two (2) months. A rezoning application is a formal request to use a particular piece of property in a manner that is inconsistent with the current City of Owasso Zoning Code by either a text or zoning map amendment. The City Planner assigned to your application will be your main contact person throughout the process. Feel free to call whenever you have questions or concerns.

Application Review

The deadline for submitting an application with the Planning Commission is the first Tuesday of each month. It is recommended that, prior to submitting an application, you schedule a pre-application meeting with the City Planner. Materials that need to be submitted at the time of application are listed below.

  1. Legal description and address of the subject property;
  2. Certified three-hundred (300) foot radius report (applicant to obtain from a title or abstract company);
  3. Filing fee (See Schedule of Fees – Planning and Zoning);
  4. Completed application form including a brief description of the proposed use of the land;
  5. Survey, site plan or drawing that shows the subject property; and
  6. For Planned Unit Developments (PUD) please submit a detailed textual statement (See Planned Unit Development Application).

Public Notice

Once the application is deemed complete, the petition is scheduled for a public hearing before the City of Owasso Planning Commission. The owners of all property within three hundred (300) feet of the perimeter of the property will be notified from a certified radius report supplied by the applicant. The City Planner will publish a legal notice in the Owasso Reporter at the applicant’s expense. The applicant will be billed directly by the Owasso Reporter.

Staff Report

The City Planner will prepare a staff report for the Planning Commission. The staff report will include background information on the subject property as well as findings related to the City of Owasso Zoning Ordinance and Comprehensive Plan. The staff report will also include a recommendation to approve or deny the request along with a map.

Planning Commission and City Council

The Planning Commission, taking into consideration staff’s recommendation and report, the testimony of the applicant or his / her duly appointed representative and any other interested parties will make a recommendation to approve or deny the application. The Planning Commission meets on the second Monday of the month at 7:00pm. If the Owasso Planning Commission denies the application, the application is not considered further unless an appeal procedure is initiated. If the application is approved, or approved with modifications, the application will automatically be scheduled for the next regular City Council meeting. It is recommended that the applicant or his / her representative be present at both the Planning Commission and City Council hearings. When the application is scheduled for the City Council, the applicant will be notified by telephone or in writing. Additionally, the applicant will be required to pay an Ordinance publication fee. At the City Council meeting, the application will be heard in a manner consistent with that of the Planning Commission. If City Council approves your request, an Ordinance will be prepared and published in the Owasso Reporter thereby completing the final step of the rezoning process.

Appeals from Council Decisions

If an application is denied, the applicant may:

  1. Revise the application and resubmit at any time;
  2. Reapply for the same zoning classification after a minimum of six (6) months; or
    File an injunction in District Court.
